Terms of Use[Poka Cam]

This agreement (hereinafter referred to as the "Terms") is a legal agreement between the user (hereinafter referred to as "You") and Pixelpunk Inc. regarding the services provided by Poka Cam. By using Poka Cam, You agree to comply with these Terms. If You do not agree, please discontinue using the services immediately.

1. General Provisions

Poka Cam services are provided in accordance with these Terms, which may be updated by Pixelpunk Inc. at its sole discretion. Updated Terms will be published within the application and take immediate effect. You are responsible for reviewing the Terms periodically. Continued use of Poka Cam constitutes acceptance of the current version of the Terms.

2. Service Overview

Poka Cam offers tools for capturing, editing, and sharing photos and videos. Additional features include applying filters and effects inspired by disposable and analog film cameras. New features or updates added to the app will also be governed by these Terms.

Poka Cam services are provided "as is." While Pixelpunk Inc. strives to maintain reliable services, it does not guarantee that services will be uninterrupted or error-free. Pixelpunk Inc. reserves the right to suspend services for maintenance, updates, or other reasons without prior notice.

3. User Conduct

By using Poka Cam, You agree not to engage in illegal or prohibited activities, including but not limited to:

1. Uploading, sharing, or transmitting content that is unlawful, harmful, defamatory, or infringes on others’ rights.
2. Engaging in unauthorized commercial activities, such as unsolicited advertising or spamming.
3. Interfering with or disrupting the service or networks connected to the service.
4. Impersonating any individual or entity or providing false information.
5. Violating any applicable laws or regulations in your jurisdiction.

Pixelpunk Inc. reserves the right to suspend or terminate access to Poka Cam if You violate these Terms.

4. Privacy Policy

Your personal information will be collected, stored, and processed in accordance with the Privacy Policy of Poka Cam. By using the service, You agree to the collection and use of your data as described in the Privacy Policy.

5. Termination of Service

Pixelpunk Inc. reserves the right to suspend or terminate services at any time, without prior notice, for reasons including but not limited to violations of these Terms. Upon termination, your data may be deleted, and access to the app may be revoked. Pixelpunk Inc. shall not be liable for any consequences arising from such actions.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Pixelpunk Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

1. The use or inability to use the services.
2. Unauthorized access to your data or transmissions.
3. Third-party actions or statements made within the app.
4. Any other matters related to the use of Poka Cam.

7. Intellectual Property Rights

Poka Cam and its associated content, including but not limited to trademarks, logos, images, and software, are the intellectual property of Pixelpunk Inc. or its licensors. You may not reproduce, distribute, or create derivative works without explicit written consent from Pixelpunk Inc.

8. Updates to the Terms

Pixelpunk Inc. reserves the right to update these Terms at any time. Updated versions will be published in the app. Continued use of Poka Cam after any update constitutes acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Pixelpunk Inc. is headquartered unless otherwise required by local laws. Any disputes arising out of or in connection with these Terms shall be resolved through friendly negotiations. If negotiations fail, disputes will be submitted to arbitration as per applicable international rules.
